General Terms and Conditions

Welcome to MYTrainer (“MYTrainer”). MYTrainer operates an online platform (the “Platform”) accessible via www.mytrainer.com.my and its associated applications that connects certified personal trainers (“Trainers”) with clients seeking personal fitness training services (“Clients” or “Users”).

By accessing or using the Platform, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms or our Privacy Policy, you MUST NOT use the Platform.

 

  1. Use of the Platform

The Platform is intended solely to facilitate the discovery, scheduling, and payment of fitness training services between Trainers and Clients. Use of the Platform is strictly voluntary. By accessing or using any part of the Platform, you confirm that you are at least 18 years old and capable of entering into a legally binding agreement.

These Terms of Use apply to your access to and use of the Platform and do not alter in any way the terms and conditions of any other agreement you may have with MYTrainer, unless otherwise directed by MYTrainer. If you breach any of these Terms, your authorization to use the Platform automatically terminates and you must immediately discontinue use of the Platform.

 

  1. Account Registration and Responsibilities

To access the Platform, both Trainers and Clients must register for an account. You agree to:

  • Provide accurate, current, and complete information and details;
  • Maintain the confidentiality of your login credentials;
  • Be fully responsible for all activity under your account.

MYTrainer reserves the right to suspend or terminate any account that provides false or misleading information or violates any part of these Terms.

 

  1. Trainer Listings and Session Locations

Trainers may list their availability and preferred training locations. Clients may browse Trainers based on the location (currently limited to Kuala Lumpur and Petaling Jaya) and request sessions accordingly.

Any session conducted outside of the Trainer’s listed location within the Platform must be mutually agreed upon at the Clients’ and Trainers’ sole risk.

The Platform solely serves to facilitate the connection between Trainers and Clients. MYTrainer is not, and shall not, in any way, be held responsible for any dispute, issue or liability arising from travel arrangements, off-location sessions, or any other agreements made directly between Trainers and Clients.

 

  1. Payments

You authorize MYTrainer and any payment processing service provider it may engage to charge your credit card, or to debit or process payment through any other offered means, for any products or services you purchase through your use of the Platform. You represent and warrant that you are the only one who will make payments in connection with the Platform, and you shall be responsible for any and all uses of your credit card, debit card, or any other payment means used in or under your name. Unless otherwise specified, any amounts paid to MYTrainer are non-refundable.

 

  1. Prohibition of Off-Platform Transactions

All bookings and payments for sessions involving Clients sourced through MYTrainer must be made through the Platform.

Trainers are strictly prohibited from entering into private arrangements with such Clients, including but not limited to any off-platform engagements..

MYTrainer disclaims all responsibility and liability for any issues, losses, or disputes arising from transactions or sessions conducted outside the Platform, including but not limited to instances where a Trainer becomes uncontactable or fails to provide the agreed services.

Trainers found in breach of this policy may face suspension or permanent removal from the Platform.

 

  1. Refund and Cancellation Policy

Please refer to the Terms and Conditions applicable to Trainers and Clients, respectively.

 

  1. Session Packages
  • Packages (e.g., 10-session bundles) are non-refundable and non-transferable.
  • Sessions are valid for use only by the account holder.
  • Refunds will be granted subject to the Platform’s Refund Policy.
  • Exceptions such as Trainer unavailability or account banning may allow for a partial refund subject to MYTrainer’s discretion.

 

  1. Platform Role and Trainer Independence

MYTrainer solely acts as an intermediary platform and is not the provider of personal training services. All Trainers are independent professionals. MYTrainer does not control or supervise the conduct, methods, or outcomes of training sessions.

MYTrainer makes no representations or warranties about the qualifications, safety, or conduct of any Trainer. All training-related claims, injuries, or disputes are solely between the Trainer and Client.

 

  1. Disclaimer of Warranties

The Platform and all content, services, and materials available are provided on an “AS IS” and “AS AVAILABLE” basis. MYTrainer disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

MYTrainer does not guarantee the Platform will be error-free, secure, or uninterrupted. You use the Platform at your own risk.

 

  1. Limitation of Liability

To the fullest extent permitted by law, MYTrainer shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from or related to your use of the Platform.

In no event shall MYTrainer’s aggregate liability exceed RM500.

 

  1. Prohibited Activities

Users of the Platform must not:

  • Violate any law or regulation;
  • Post false, abusive, offensive, or defamatory content;
  • Infringe on third-party intellectual property rights;
  • Engage in harassment or impersonation;
  • Transmit viruses, malware, or harmful software;
  • Collect user data without consent;
  • Interfere with the operation or security of the Platform;
  • Use bots or scraping tools without permission;
  • Use the Platform for any unauthorised commercial purpose.

 

  1. User Content and Platform Rights

Users may be permitted to post content to the Platform, including profile information, reviews, messages, or other materials (“User Content”). By posting or submitting any User Content, you represent and warrant that:

  • You own or have the necessary rights to submit such content;
  • The content is accurate and not misleading or unlawful;
  • It does not violate any applicable laws, privacy rights, or intellectual property rights.

You grant MYTrainer a worldwide, royalty-free, non-exclusive, perpetual, and irrevocable right to use, reproduce, modify, display, distribute, and store your User Content in connection with the operation and promotion of the Platform.

MYTrainer reserves the right, but is not obligated, to review, monitor, edit, or remove User Content at its sole discretion. You are solely responsible for any content you upload and its consequences.

 

  1. Data Use and Consent

By using the Platform, you consent to MYTrainer collecting, storing, and using your personal data as outlined in our Privacy Policy. This includes but is not limited to:

  • Information you provide during account registration and profile setup;
  • Booking and session history;
  • Messages exchanged with Trainers or Clients through the Platform;
  • Payment and wallet activity.

Trainers who receive access to limited Client information (such as name, booking schedule, and fitness goals) agree to use such data solely for the purposes of providing fitness services via the Platform. Trainers are bound to use this information strictly for service-related purposes and in accordance with applicable data protection laws. Any misuse, disclosure, or unauthorized storage of personal data may result in account suspension and legal action.

MYTrainer retains personal data in accordance with its Privacy Policy and applicable law. By using the Platform, you agree to the data retention practices described in our Privacy Policy.

 

  1. Waiver of Liability by Clients

By using the Platform, you acknowledge and voluntarily assume all risks associated with fitness training. You agree to release MYTrainer from all claims or liabilities arising from personal injury or loss during sessions.
All disputes, claims, or complaints relating to training must be directed to the respective Trainer.

 

  1. Intellectual Property

All content, software, trademarks, logos, and designs on the Platform are the property of MYTrainer or its licensors. You may not reproduce, distribute, or modify any part without express written permission of MyTrainer.

 

  1. Links to Third-Party Sites

The Platform may contain links to external websites. MYTrainer does not control and is not responsible for the content, policies, or practices of such sites. Inclusion of any link does not imply endorsement.

 

  1. Modifications to the Platform and Terms

MYTrainer reserves the right to modify the Platform and these Terms at any time. Updated Terms will be posted on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.

 

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia. Any disputes arising shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

Use of the Platform is not permitted in any jurisdiction that does not give full effect to these Terms.

 

  1. Entire Agreement and Severability

These Terms constitute the entire agreement between you and MYTrainer. If any provision is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
